Terms & Conditions

The rules for using the Bara platform.

Effective date: October 5, 2025

Please read these Terms carefully. Your continued use of Bara signifies that you understand and accept the obligations below.

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Bara platform, mobile applications, APIs, and related services delivered by Tanglobal Ltd. By creating a workspace, inviting users, or accessing Bara in any way, you agree to these Terms on behalf of yourself or the organisation you represent.

2. Account responsibilities

Workspace owners control billing, permissions, and compliance settings. You are responsible for keeping login credentials secure and for all activity that occurs under your accounts. Notify us immediately of any unauthorised access or suspected breach.

3. Service scope

Bara provides digital tools for fleet orchestration, load management, documentation, analytics, and communications. We may update or improve functionality at any time. Some features require verified company information, integrations, or add-on subscriptions.

4. Subscriptions and payments

Paid plans are billed according to the pricing agreed upon in your order form or subscription plan. Charges may include usage-based fees (for example, per shipment or per driver). Unless stated otherwise, invoices are due within 30 days. Late payments may incur finance charges or suspension.

5. Fleet and driver compliance

You must ensure all fleet data, licences, insurance, and regulatory documents uploaded to Bara are current and accurate. Tanglobal does not certify driver qualifications or vehicle roadworthiness; Bara is a coordination platform, not a carrier or insurer.

6. Acceptable use

Do not misuse Bara by attempting to probe or breach security, upload malicious code, abuse communication tools, or violate applicable laws. We may suspend or terminate access where unacceptable use occurs.

7. Confidentiality and data

We safeguard customer data according to our Privacy Policy and data processing agreements. You retain ownership of operational data you upload. By using Bara you grant us the rights needed to host, analyse, and process data to deliver the services.

8. Intellectual property

Tanglobal owns all rights to the Bara technology, branding, and content except where we incorporate open-source or third-party components. You may not copy, modify, or create derivative works without written consent.

9. Term and termination

These Terms remain in effect while you use Bara. You may stop using the service at any time. We may terminate or suspend access for breach of the Terms, non-payment, or to comply with law. Upon termination we will make account data available for export for a limited period.

10. Disclaimers

Bara is provided 'as is' and 'as available' without warranties of any kind, whether express, implied, or statutory. We do not guarantee uninterrupted service or error-free operation but we commit to commercially reasonable support and security practices.

11. Liability limitations

To the maximum extent permitted by law, Tanglobal and its suppliers are not liable for indirect, incidental, special, or consequential damages, or lost profits, revenues, data, or goodwill. Our aggregate liability under these Terms will not exceed the total fees paid to Tanglobal in the 12 months before the event giving rise to the claim.

12. Governing law

These Terms are governed by the laws of the United Republic of Tanzania without regard to conflict of laws principles. Disputes will be resolved in the courts located in Dar es Salaam unless otherwise agreed in writing.

13. Changes to the Terms

We may update these Terms to reflect new services or legal requirements. When we do, we will notify workspace owners and post the effective date. Continued use after updates constitutes acceptance of the revised Terms.
